Gifting property to family in Dubai: what first-degree relatives need to know

A gift transfer, sometimes called a hiba, moves ownership of a Dubai property to a first-degree relative without a sale. It is commonly used for estate planning, for adding a spouse to a title or for passing a property to a child.

Who counts as a first-degree relative

The DLD recognises gifts between spouses, and between parents and children. Proof of the relationship is required, such as a marriage certificate or birth certificate, legally translated and attested where issued abroad.

The reduced transfer fee

Gift transfers between eligible relatives attract a reduced DLD fee compared with the standard sale transfer fee of 4%. We confirm the current percentage and all official charges in writing before you commit.

The process

The steps mirror a standard transfer: documents are gathered and verified, a valuation may be obtained, the NOC is requested from the developer, and the transfer is completed at a trustee office. If the property has a mortgage, the bank's consent is needed first.

How we help

We check eligibility, prepare and translate the relationship documents, manage the NOC and attend the trustee office with you or on your behalf under a Power of Attorney. Enquire today to confirm whether your gift qualifies.
